Is the independent public supervisory Authority responsible for the supervision of the investment services market and transactions in transferable securities carried out in the Republic of Cyprus.
The CySEC was established in accordance with section 5 of the Securities and Exchange Commission (Establishment and Responsibilities) Law of 2001 as a public legal entity.
The operation of the CySEC is governed by the Laws regulating the Structure, Responsibilities, Powers, Organization of the Cyprus Securities and Exchange Commission and Other Related Matters (L73(I)/ 2009). Our license is subject to the Cyprus Investment Services and Activities and Regulated Markets Law L. 87(I)/2017, which is harmonized with the requirements of the European Parliament’s Markets in Financial Instruments Directive II (MiFID II) to ensure a high level of protection for investors and that the investment services we offer comply with applicable regulations. Key Way Investments Ltd operates in accordance with the Markets in Financial Instruments Directive II (MiFID II) of the European Union. MiFID II provides a harmonized regulatory environment for investment services across the European Economic Area (EEA). The main objectives of the MiFID II Directive are to strengthen investor protection, reduce the risks of a disorderly market, reduce systemic risks, increase the efficiency of financial markets and reduce unnecessary costs for participants, enhance financial transparency and increase competition. More specifically, MiFID II seeks to ensure fairer, safer and more efficient markets and facilitate greater transparency for all participants.

Key Way Investments Ltd is a member of the Investor Compensation Fund (ICF), set up by the Cyprus Securities and Exchange Commissions (CySEC) for clients of Cyprus Investments Firms (CIFs). The ICF is a statutory fund of last resort for clients of CIF’s. This means that the ICF can compensate covered clients of a CIF if it is unable, or likely to be unable, to pay claims against it (e.g. in the unlikely event of default or financial distress). Membership of the ICF ensures that covered clients of Key Way Investments Ltd can claim compensation in such cases. This provides Key Way Investments Ltd clients with an extra measure of insurance for their funds. The ICF covers retail Clients of Key Way Investments Ltd only. Under the Rules and Regulations of the ICF, the total payable compensation to each covered client may not exceed €20.000, irrespective of the number of accounts held, currency and place of offering the investment service. Complaint

Handling of your Complaint

Once we acknowledge receipt of your complaint we will review it carefully, investigate the circumstances surrounding your complaint and will try to resolve it without undue delay. We shall make every effort to investigate your complaint and provide you with the outcome of our investigation within two months from the date you have submitted your complaint to us.

During the investigation process will keep you updated of the handling process of your complaint. One of our officers may contact you directly (including communication by email or phone) in order to obtain, where needed, further clarifications and information relating to your complaint. We will require your full cooperation in order to expedite the investigation and possible resolution of your complaint.

In the event that your complaint requires further investigation and we cannot resolve it within two months, we will issue a holding response in writing or other durable medium. When a holding response is sent, it will indicate the causes of the delay and when the Company’s investigation is likely to be completed. In any event, we shall provide you with the outcome of our investigation no later than one month from the issuing of the holding response, depending on the complexity of the case and your cooperation.

Please note that the Company shall consider your complaint as closed and cease the relevant investigation in case you fail to respond to our officers within the period of three months from the date of the submission of your complaint. When we reach an outcome we will inform you of it together with an explanation of our position and any remedy measures we intend to take (if applicable).

If you are not satisfied with the Company’s final decision you may submit your complaint to the Financial Ombudsman of the Republic of Cyprus and seek mediation for possible compensation. It is important that you contact the Financial Ombudsman of the Republic of Cyprus within four months of receiving a final response from the Company otherwise the Financial Ombudsman of the Republic of Cyprus may not be able to deal with your complaint. In the unlikely event that the Company was unable to provide you with a final response within the three month time period specified above you may again contact the office of the Financial Ombudsman of the Republic of Cyprus no later than four months after the date when we ought to have provided you with our final decision.
